California Regulates Advanced AI Systems

Published on 4.23.25

The regulation of artificial intelligence (AI) has become a pressing concern in California, with two separate legislative proposals aiming to address safety and ethics issues surrounding AI development. The first proposal, SB 813, seeks to establish a voluntary regulatory framework for advanced AI systems, developed by independent experts through a "third-way" governing model. This approach balances innovation with safety concerns by providing incentives for developers who opt-in, including legal protections under state law. A key aspect of this framework is the inclusion of third-party assessments and public disclosure of safety standards, which is seen as a pragmatic approach to governance that will help keep residents safe while preserving innovation in AI development. This model has been praised for its ability to adapt to the rapidly evolving field of AI. The proposed regulatory framework specifically aims at protecting minors from potential harm caused by AI technology. The measure would limit the use of minors' data for training AI models and grant parents the right to sue developers if their child is harmed by the technology. This approach has been successful in promoting transparency and accountability in the industry, similar to the EU's regulatory model. If enacted, this law would be a significant step towards ensuring the safe development and deployment of advanced AI systems in California.
